Who can apply online, and who can't

Online: only when the company is formed in the US, is run from the US, and the person in charge has an SSN or ITIN. The number comes at the end of the session.

Everyone else, including owners outside the US: by phone, fax or mail, as the Form SS-4 instructions set out. No ITIN is needed.

Questions people ask

Do I need an ITIN or SSN first?

No. Owners without either can still get an EIN: the application allows "foreign" in place of a US tax number. It just can't be done online.

Is the EIN free?

Yes, the IRS charges nothing. You pay us for preparing, filing and tracking the application.

How long does it take?

Online or by phone, the IRS assigns the number straight away. By fax it usually takes 4 business days or less, and by mail about 4 weeks. We track the application until the number arrives.

Who is the "responsible party"?

The person who ultimately owns or controls the company. It has to be an individual, not another company.

I'm the only owner and I live abroad. Anything else?

Yes. Your LLC is a foreign-owned US company in the IRS's eyes, which means filing Form 5472 every year, even with no income. We note this on the application and remind you each year.
